'The Sun Behind the Clouds' to be screened in Mumbai
(2009, India/UK, 79 minutes)

Delhi-based filmmakers, Ritu Sarin and her Tibetan partner Tenzing Sonam, announce the Mumbai and Delhi premieres of their film, The Sun Behind the Clouds: Tibet’s Struggle for Freedom. The film will screen in Mumbai on 7th February 2010 as part of the international competition section of the Mumbai International Film Festival and in New Delhi on 12th February 2010 at the India International Centre in an event hosted jointly by the IIC and The Foundation for Universal Responsibility.

In The Sun Behind the Clouds, Sarin and Sonam take a uniquely Tibetan perspective on the trials and tribulations of the Dalai Lama and his people as they continue their struggle for freedom in the face of determined suppression by one of the world’s biggest and most powerful nations. The filmmakers had intimate access to the Dalai Lama and followed him over the course of an eventful year, which included the 2008 protests in Tibet, the international response to it, the Beijing Olympics, and the breakdown in talks between the Dalai Lama and the Chinese government. Set against this backdrop, the film explores the interplay between the personal and the historic, spirituality and politics, and the tension between the Dalai Lama's efforts to find a peaceful resolution to the Tibet situation based on compromise and
dialogue, and the impatience of a younger generation of Tibetans who are ready to take a more confrontational course.

The film had its North American premiere at the recently concluded Palm Springs International Film Festival in California where it became the focus of much media attention when the Chinese government tried to get the festival to remove the film, ostensibly for its anti-China stand. When the festival refused, two Chinese films were withdrawn in retaliation. The film had three sold-out screenings and a fourth was added when it was voted one of the Best of the Fest films.

Variety, the leading US film trade journal, said of the film: “In a welcome departure from many previous films about the decades-long friction between Tibet and China, "The Sun Behind the Clouds: Tibet's Struggle for Freedom" provides a two-sided view of the complex political and social dynamics within and outside Tibet. For the "struggle" in the film's title is not merely against China but also
between competing Tibetan views regarding the best strategy: co-existence or independence.”

The Hollywood Reporter added: “The film is essential viewing for anyone who cares about the fate of the mountain region and the legacy of the Dalai Lama.”

Two Tibetans were executed in Lhasa for their alleged roles in the protests and rioting in Lhasa on March 14, 2008, according to reports by Tibetan exile organizations confirmed by the Chinese embassy in London on Friday (October 23). Lobsang Gyaltsen and Loyak were sentenced to death in April 2009 on charges relating to "starting fatal fires," according to a report in the Chinese state media. They are the first known executions of Tibetans in connection with the Lhasa riot on March 14, 2008 although others have been killed following torture in custody.

The Dharamsala, India-based NGO Gu Chu Sum, which helps former political prisoners, reported on the executions on October 21, however, the executions of two other Tibetans in Lhasa, a woman called Penkyi and an unnamed Tibetan reported by the Tibetan Center for Human Rights and Democracy (TCHRD) based in Dharamsala, were not officially confirmed. A Tibetan woman, Penkyi, from Shigatse, had received a suspended death sentence, although it is rare that people given suspended death sentences in China are actually executed.

TCHRD reported that the body of Lobsang Gyaltsen (Chinese transliteration: Losang Gyaltse) was handed over to his family after the death sentence had been carried out by shooting, and was later immersed in the Kyichu (Lhasa) river. It is not known why a river burial, rare in Lhasa compared to sky burials, was carried out. The ashes of Loyak were returned to his family, TCHRD reported.

The first strong public statement from a foreign government came from the British Foreign Office Minister Ivan Lewis, who raised concern about both death penalty cases during the first UK Ministerial visit to Lhasa last month. In a statement on the Foreign Office website, Mr. Lewis said: "I condemn the recent executions in Lhasa of two Tibetans, Mr Lobsang Gyaltsen and Mr Loyak. We respect China's right to bring those responsible for the violence in Tibet last year to justice. But the UK opposes the death penalty in all circumstances, and we have consistently raised our concerns about lack of due process in these cases in particular." Mr. Lewis said that during his visit to the Tibet Autonomous Region in September he had urged the authorities not to carry out the death sentence, and he called on China to review urgently the cases of those who remain under sentence of death for their alleged involvement in last year's unrest. An official report on April 8, 2009, stated that Losang Gyaltse [Gyaltsen] had been sentenced to death "for setting fire to two garment shops in downtown Lhasa on March 14 that killed a shop owner Zuo Rencun", according to a spokesman for the Lhasa Municipal Intermediate People's Court (Xinhua). In another case, Loyak received the death penalty for allegedly setting fire to a motorcycle dealership in Dechen township in Lhasa's Taktse (Chinese: Dagze) county on March 15 last year, according to the same article, leading to the deaths of five people.

Lobsang Gyaltsen was in his early twenties and from Lubuk township, according to the Tibetan language service of Radio Free Asia (October 24). The same source said: "His mother's name is Yudon-la and he has a stepfather. Their living conditions are extremely poor, and they are dependent on food assistance from Lhasa city committee." Before his execution, the source said, Lobsang Gyaltsen was permitted a visit with his mother. "I have nothing to say, except please take good care of my child and send him to school," he was quoted as telling her.

The court spokesperson said: "The two defendants [Lobsang Gyaltsen and Loyak] given death penalties had committed extremely serious crimes and have to be executed to assuage the people's anger. For those defendants who deserve lesser punishments under statutory or discretionary circumstances, they were given lighter punishments according to the law," he said. (Xinhua, April 8, 2009.)

Often in the People's Republic of China, death sentences are passed months or even weeks after a suspect has been detained on suspicion of committing a capital crime. In the cases in Lhasa, sentencing took more than a year and may be due to the political sensitivities of the case.

The reports of two other executions have not been officially confirmed. There were earlier official reports of three further death sentences, all imposed with two-year reprieves, according to state media reports published on April 8 and April 21, 2009. Penkyi, who was reportedly also executed according to TCHRD, was one of those Tibetans. Penkyi, of Sakya (Chinese: Sajia) county in Shigatse (Chinese: Rikaze) prefecture, and two other Tibetan women were found guilty of starting a fatal fire in a Lhasa clothing shop that resulted in the deaths of five shop employees. There is no evidence that these young women were granted a fair trial and proper legal access in accordance with China's own laws. Tibetans have been denied the right to be represented by the lawyer of their choice due to the highly political nature of the cases, with several lawyers being threatened with disbarment if they attempted to represent detained Tibetans. It was also reported that a Tibetan named Gangstu, who was allegedly involved in the same incident as Loyak, was given a death sentence with a two-year reprieve. A fifth Tibetan,Tenzin Phuntsog, was sentenced to death reprieved for two years for setting fire to a garment shop in which the husband and wife owners of the shop were injured and their daughter killed. It is unlikely Tenzin Phuntsog has been executed, following an official spokesman's statement in the state media when the sentences were announced that the court had been lenient on Tenzin Phuntsog because "he had been put up to the violence," and had "showed a positive attitude in admitting his crime after he was arrested," a reference to the Chinese authorities' assertion that the 'Dalai clique' orchestrated the protests. A suspended death sentence is one where a death sentence is imposed, but it is postponed for two years while the prisoner's behavior continues to be assessed. It is rare, however, that people given suspended death sentences are actually executed. Those who have been executed committed significant transgressions in prison, such as violence against other prisoners or prison staff.

Radio Free Asia referred to the executions of a third unnamed man from Amdo in eastern Tibet and a woman identified as 'Nyimo'. This could be a reference to an area of Lhasa called Nyemo where she might be from. TCHRD and the Tibetan political prisoners organization Gu Chu Sum reported the name of the woman who was executed as Penkyi. (http://www.rfa.org/english/news/tibet/execute-10242009185910.html) The April 21, 2009 China Daily article reported that a 23-year old female from Nyemo named Penkyi was sentenced to life imprisonment as part of the arson case which resulted in a suspended death sentence for the woman named Penkyi of Sakya county. The same China Daily article also reported that "the court showed leniency on the two Penkyis," who were accused of leading the arsons, because they "had turned themselves in to police." Until the UK government's statement on Friday there had been no official confirmation of the executions, which may be indicative of the sensitive political climate following the crackdown imposed after the protests began in March, 2008. According to Radio Free Asia, an official at the Lhasa People's Intermediate Court referred questions about the executions to a colleague and asked reporters to phone back later, at which time the phone rang unanswered.

The last known case of the execution of a Tibetan was in 2003, when Lobsang Dhondrub was executed for alleged involvement in a bomb blast in Chengdu in April 2002. This was linked to the case of Tenzin Deleg Rinpoche, a respected religious teacher whose death sentence was commuted to life. On January 26, 2003, the Sichuan High People's Court rejected Tenzin Delek Rinpoche's appeal against his sentence and the appeal that had apparently been entered for Lobsang Dhondrub. Within hours Lobsang Dhondrub was executed. Some reports suggest he was executed very early in the morning of that day, even before the appeal was formally rejected.

During a 'Strike Hard' campaign in 1996 in Tibet, there were official press reports of 29 executions, of which 18 were Tibetans, and all for non-political crimes. During this same campaign, more than 2,200 people were executed across China.

The executions of Lobsang Gyaltsen and Loyak in Lhasa were carried out in the context of a severe crackdown that began last year following the wave of protests that swept across the Tibetan plateau from March 10, 2008. State repression and the hardening of the Chinese government's position on the Dalai Lama have created deepening tension in Tibet, and over the past year the Chinese government has sought to cover up the torture, disappearances and killings that have taken place across Tibet following the protests and dissent.

Ngawang Sangdrol's case history

Born in 1977 in Lhasa, Ngawang Sangdrol, layname Rigchog, joined Garu Nunnery at a very young age.

In 1987, 10-year-old Sangdrol participated in a peaceful pro-independence demonstration and was subsequently detained for 15 days. On 28 August 1990, she was detained for nine months for participating in another demonstration. A year later, she was sentenced to three years' imprisonment in Drapchi Prison for once again staging a demonstration.

In 1993, Sangdrol and 13 other nuns in Drapchi Prison made a tape-recording of the brutal treatment suffered and of their unfaltering commitment to Tibetan independence. The tape was smuggled out and circulated throughout Tibet. Sangdrol was found guilty of "spreading counter-revolutionary propaganda" and had her sentence extended by an additional six years.

On 31 July 1996, Sangdrol received an additional eight years on her prison term, raising her total sentence to 17 years on alleged charges of failing to clean her room. Actually, she refused to rise to her feet when a communist party delegation visited her cell. Her physical condition deteriorated due to torture, with her right leg seriously injured.

During the Drapchi prison protest in May 1998, all prisoners were beaten with particular ferocity meted out to Sangdrol. She was severely beaten and tortured. Lhasa Intermediate People's Court extended Sangdrol's sentence. Despite conflicting reports about the length of this sentence extension, TCHRD maintains by the fact that Sangdrol received four years sentence extension bringing her total sentence to 21 years.

Pechino (AsiaNews) - Per celebrare i 60 anni dalla Dichiarazione universale dei diritti umani, 303 cittadini cinesi (intellettuali, imprenditori, contadini, semplici cittadini) hanno sottoscritto il documento “Carta 08”, che chiede al governo maggiore democrazia e rispetto di tutti i diritti umani. “Carta 08” si richiama a “Carta ‘77”, il documento firmato da intellettuali e attivisti cechi e slovacchi nel 1977, che premeva sul governo est-europeo per il rispetto dei diritti umani.
A distanza di un mese e mezzo nel Paese proseguono le adesioni al documento, ma anche censura, persecuzioni e arresti contro autori e firmatari.

Dharamsala (AsiaNews) – “La campagna anticrimine lanciata in Tibet dal governo cinese è un tentativo strategico e sistematico di eliminare la stessa comunità tibetana come etnia. C’è il pericolo che abbia successo”. L’accusa di genocidio in atto è lanciata da Urgen Tenzin, direttore esecutivo del Centro tibetano per i diritti umani e la democrazia, che raccoglie tibetani in esilio.

Dal 18 gennaio la polizia cinese in Tibet ha lanciato una grande campagna, che dice finalizzata a debellare il crimine. Ha impiegato circa 600 funzionari con 160 veicoli. Nella sola Lhasa sono già stati controllati e sentiti 5.766 “sospetti”, perquisiti edifici e 2922 case affittate, 14 alberghi e pensioni, vari bar e internet café. I turisti che vogliono stare a Lhasa per più di 3 giorni, debbono ottenere dalla polizia un permesso di residenza temporaneo.

Ma Urgen Tenzin osserva che oggetto di perquisizioni e interrogatori sono anzitutto i tibetani che contestano il governo cinese, che subiscono anche arresti arbitrari, perdita di posto di lavoro ed espulsione da istituti religiosi. Ricorda che “dal 10 marzo al dicembre 2008 abbiamo documentato tramite fonti certe l’arresto di 6.500 tibetani nella regione, di cui 5.766 sono stati tenuti in carcere. Molti tibetani sono stati rilasciati dopo aver loro estorto ‘confessioni’ tramite torture fisiche e psichiche, molti di questi sono stati mutilati e sfregiati per sempre. Migliaia di loro sono ‘scomparsi in modo involontario’. Il presidente cinese Hu Jintao parla di società armoniosa, ma la realtà è del tutto diversa”. L’obiettivo è anche prevenire proteste per i 50 anni di esilio del Dalai Lama, che ricorrono il 10 marzo.

Urgen precisa che è la stessa strategia in atto da decenni, che opera “una abietta discriminazione a favore degli etnici cinesi Han e a danno dei tibetani, nella vita di ogni giorno c’è la strategia di offendere i sentimenti dei tibetani per farli reagire. Provocano alla protesta i tibetani che hanno una cultura di pace e non violenza”.

“Anche a scuola i bambini tibetani sono obbligati a studiare il cinese e sono alienati dalla loro identità e cultura. Per questo molte famiglie cercano di mandare i figli a studiare in scuole tibetane in India”.

“Chiediamo alla comunità internazionale e a tutti i Capi di governo sforzi effettivi per risolvere il problema tibetano e lavorare per la giustizia e la pace nel mondo”.

Continuano le condanne di tibetani ad anni di carcere
La Cina tiene in carcere da marzo e condanna in silenzio chi ha protestato in Tibet e Sichuan contro la violenza della polizia e per ottenere maggiore libertà. All’epoca ci sono state proteste in tutto il mondo, che hanno fatto preoccupare Pechino.

Fonti locali riferiscono all’agenzia Radio Free Asia che di recente “la Corte intermedia del popolo di Ganzi, Sichuan, ha condannato i monaci Orgyen Tashi e Tenzin Ngodrub a 3 anni di carcere” per le proteste del 18 marzo a Ganzi, sebbene siano state “pacifiche”. Rimane “ignoto” il destino del monaco Lobsang detenuto con loro, ma “la cui famiglia manca del tutto notizie anche su dove sia in carcere”.

Le proteste sono esplose, per le violenze della polizia cinese, non solo in Tibet ma anche in Sichuan, dove ci sono vaste enclavi di etnia e cultura tibetane. Il governo tibetano in esilio denuncia oltre 200 morti e migliaia di arrestati, mentre la Cina dice che la polizia ha ucciso solo “un rivoltoso” e accusa i dimostranti di avere ucciso 21 persone.

Sono stati pure condannati a 3 anni di carcere per le proteste del 18 marzo i tibetani Pema Deshey, Tashi Palden, Goga e Sangpo, che “hanno subito gravi percosse sia nei 3 mesi nel carcere di Ganzi”, che “negli oltre 6 mesi poi passati nella prigione di contea a Xinlong”.

Oltre 200 tibetani sono stati arrestati per le proteste di Ganzi. Caricati su un autocarro, molti sono stati portati altrove sotto scorta armata e i loro effetti personali restituiti ai parenti. “Circa 20 sono stati rilasciati – spiega un’altra fonte – e un altro 70% condannati a detenzioni di varia durata”. “E’ stato pure condannato in segreto a 3 anni il monaco Sherab del monastero Khangmar”. “Il monaco Tsering Phuntsog di Khangmar ha ricevuto una condanna di 2 anni e mezzo e il giovane Palden Wangyal, 19 anni, a 3 anni”, sempre “in segreto, per timore delle reazioni dei tibetani”.

A marzo la repressione e gli arresti hanno causato proteste in tutto il mondo e proposte di boicottare le Olimpiadi di Pechino. Per calmarle, all’epoca la Cina ha accettato di aprire un “dialogo” con rappresentanti del Dalai Lama. Dopo le Olimpiadi, ha ribadito che considera il Dalai Lama “un terrorista” e non intende accogliere alcuna richiesta di autonomia per il Tibet o salvaguardia della sua cultura.

Human Rights Day

Human Rights Day is observed by the international community every year on 10 December. It commemorates the day in 1948 the United Nations General Assembly adopted the Universal Declaration of Human Rights.
The formal inception of Human Rights Day dates from 1950, after the Assembly passed resolution 423 (V) inviting all States and interested organizations to adopt 10 December of each year as Human Rights Day.
When the General Assembly adopted the Declaration, with 48 states in favor and eight abstentions, it was proclaimed as a "common standard of achievement for all peoples and all nations", towards which individuals and societies should "strive by progressive measures, national and international, to secure their universal and effective recognition and observance". Although the Declaration with its broad range of political, civil, social, cultural and economic rights is not a binding document, it inspired more than 60 human rights instruments which together constitute an international standard of human rights. Today the general consent of all United Nations Member States on the basic Human Rights laid down in the Declaration makes it even stronger and emphasizes the relevance of Human Rights in our daily lives.
The High Commissioner for Human Rights, as the main United Nations rights official, and her Office play a major role in coordinating efforts for the yearly observation of Human Rights Day.

Il primo ministro della diaspora tibetana riafferma il dialogo come unico mezzo di confronto con la Cina, ma avverte di non poter più chiedere alla popolazione di rimanere calma. Il Dalai Lama annuncia che la sua reincarnazione avrà soltanto un peso spirituale.

Dharamsala (AsiaNews/Agenzie) – Il governo tibetano in esilio “ripone ancora delle speranze” in una soluzione pacifica alla questione tibetana, che possa condurre la regione verso una “sostanziale autonomia” nonostante “la posizione contraria della Cina”.

Lo ha detto ieri il primo ministro del governo tibetano in esilio, Samdhong Rinpoche, che ha aggiunto: “In passato abbiamo chiesto ai nostri concittadini rimasti in patria di non creare problemi alla Repubblica popolare cinese, ma Pechino non ha tenuto in considerazione il nostro gesto ed ha continuato ad attaccare il Dalai Lama. In queste circostanze, non possiamo continuare a chiedere al nostro popolo di rimanere tranquillo”.

In ogni caso, ha aggiunto, questo atteggiamento “non cambia la nostra politica, che si basa sul dialogo. Speriamo di poter al più presto riprendere i colloqui bilaterali con la Cina e giungere così ad una conclusione della vicenda”.

Nello stesso tempo, il Dalai Lama ha annunciato che la sua prossima reincarnazione “potrebbe non aver alcun peso politico sulla regione”. Il 14° “dio-re” del Tibet ha spiegato che “nel 2001 è stata eletta democraticamente una leadership politica, che ora ha il compito di guidare la diaspora tibetana ed i nostri confratelli rimasti in patria. Il prossimo Dalai Lama sarà forse solo una guida spirituale”.

In questo modo, vengono svuotati i tentativi di Pechino di guidare a una scelta politica del futuro Dalai Lama. Dopo aver nominato un nuovo Panchen Lama (la seconda carica per importanza del buddismo) ed aver sequestrato quello riconosciuto in modo legittimo, nel luglio 2005 Pechino ha annunciato che sarà il governo locale a riconoscere il nuovo Dalai Lama.
La Cina definisce la sua pluridecennale occupazione del Tibet, come una liberazione che ha salvato i tibetani della regione dall'oppressione feudale. Pechino ha creato in maniera formale una Regione autonoma tibetana nel 1965, ma il Dalai Lama sostiene che questa non ha reale autonomia dal governo centrale.
